In response to the Domestic and Family Violence Protection and Other Legislation Amendment Bill 2026, QIDAN highlighted the need to ensure Queensland’s domestic and family violence (DFV) laws are accessible and do not further criminalise people with disability. QIDAN is concerned that people with impaired decision-making capacity may be subject to Domestic Violence Orders (DVOs) or Police Protection Directions (PPDs) without having the capacity to understand or comply with them. This can result in repeated breaches, criminal convictions and imprisonment, while providing inadequate protection for victim survivors.
QIDAN has recommended stronger safeguards, including recognising when a person with disability cannot understand the nature, purpose and legal implications of a DVO or PPD, improving disability awareness and access to disability information for police, and funding a pilot Justice Support DFV program to provide disability advocacy within the criminal justice system. QIDAN has called for DFV justice responses that are accessible, inclusive and responsive to the needs of people with disability.
